Acceptance of Terms

These Terms of Service are an agreement between you and Ether Creative Technology Inc. (“Ether”, “we”, “us”). By accessing or using the Ether website, platform and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not access or use our services.

Use of Services

Ether provides interactive brand experiences, games, measurement tools and related services. Your use of these services is subject to these terms and any additional guidelines that may apply to specific features, including our Ethical Use Policy.

You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of our services complies with applicable laws and regulations.

User Accounts

When you create an account with Ether, you must provide accurate and complete information. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

We reserve the right to disable any user account if we believe you have violated these terms or if your account shows suspicious activity.

Intellectual Property

All content, features, and functionality of the Ether platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the design, selection, and arrangement thereof, are owned by Ether Creative Technology Inc., its licensors, or other providers of such material.

These materials are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Prohibited Uses

You agree not to use the Ether platform or services to:

• Violate any applicable law, regulation, or third-party rights
• Transmit any material that is defamatory, offensive, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Engage in any activity that could damage, disable, or impair the functioning of our services
• Attempt to gain unauthorized access to any part of our services or systems
• Collect or harvest user data without permission

Limitation of Liability

To the fullest extent permitted by law, Ether shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Any content obtained from the services
• Unauthorized access, use, or alteration of your transmissions or content

Disclaimer of Warranties

Ether provides its services on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the operation or availability of our services. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms limits rights that consumer protection law grants you and that cannot be waived by contract.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the services will be brought before the courts sitting in the judicial district of Toronto, Ontario, and you consent to their jurisdiction, subject to any mandatory rules of the jurisdiction in which you reside.

The parties have expressly requested that these Terms and all related documents be drawn up in English. Les parties ont expressément demandé que ces conditions et tous les documents qui s’y rattachent soient rédigés en anglais.

Changes to Terms

We may revise these Terms of Service from time to time. The most current version will always be posted on our website. By continuing to use our services after revisions become effective, you agree to be bound by the revised terms.
